I. Definitions
For the purposes of these Terms and Conditions, the following capitalised terms shall have the meanings set out below:
- Application / ARTGOART Platform – the IT system operated by ARTGOART, available via the website and mobile applications, enabling contact between Artists (Managers) and Clients for the presentation, promotion, ordering and performance of artistic and event-related services.
- Client Application – the part of the ARTGOART Platform intended for Clients, enabling them to search for Artists, review their offers, browse profiles, and book services.
- ARTGOART / Platform Operator – the entity managing the ARTGOART Platform and providing electronic services consisting in making available the technological infrastructure enabling contact between Artists (Managers) and Clients.
- ARTGOART Price List – a document specifying the scope of services provided by the Platform Operator and the amount of fees and commissions payable to ARTGOART by Artists (Managers) for the use of the Platform.
- DSA – Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (Digital Services Act).
- Client – a natural person, legal person, or organisational unit without legal personality using the ARTGOART Platform to search for and book services offered by Artists (Managers).
- Artist (Manager) Account – an individual account on the Platform enabling an Artist (Manager) to manage their offer, availability calendar, communication with Clients, and booking requests.
- Trial Period – a trial period allowing a new user to use selected Platform functionalities free of charge for a period specified in the ARTGOART Price List.
- Fees – all amounts payable by the Artist (Manager) to ARTGOART in connection with the use of the Platform, in particular: (a) commissions on completed bookings, (b) fees for additional services offered by the Platform, and (c) other fees indicated in the ARTGOART Price List.
- Payment Operator / Payment Service Provider – an external payment services provider enabling payments between Clients and Artists (Managers) via the Platform.
- Artist / Partner / Manager – a natural person carrying on a business or artistic activity, a legal person, or an organisational unit without legal personality, using the Platform to offer artistic or event-related services.
- Artist Profile – a public profile created by an Artist or Manager on the Platform, containing in particular the stage name or business name, description of artistic activity, portfolio or promotional materials, offered services, service prices, available dates, and Client reviews.
- Booking – an order placed by a Client for a service offered by an Artist through the Platform by selecting a date and the scope of the service.
- Terms and Conditions / Terms – this document setting out the rules for using the ARTGOART Platform.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council concerning the protection of personal data.
- Agreement – the agreement concluded between the Platform Operator and the Artist at the time of registration of the Artist (Manager) Account and acceptance of these Terms.
- ARTGOART Services – services provided electronically by the Platform Operator consisting in making available technological tools enabling the presentation of artistic offers, contact between Artists and Clients, and the making of Bookings.
- Artist Service – an artistic or event-related service offered by the Artist through the Platform, including in particular musical performances, DJ services, event hosting, stage performances, animation, artistic shows, event decoration, and other services connected with event organisation.
- Website – the official website of the ARTGOART Platform enabling access to the system.
- Manager – a natural person, legal person, or organisational unit without legal personality authorised by an Artist, artistic group, creator, or other entity offering services through the Platform to manage one or more Artist Profiles, in particular with respect to publishing offers, handling correspondence, managing the availability calendar, accepting Bookings, and organising cooperation with Clients.
II. Introductory Provisions. Contact Details
These Terms set out the rules for the use of the ARTGOART Platform and the conditions for the provision of electronic services by the Platform Operator.
The ARTGOART Platform constitutes a tool enabling intermediation in contacts between Artists offering artistic services and Clients interested in booking such services.
The Platform Operator is not a party to agreements concluded between Artists and Clients concerning the performance of artistic services, unless otherwise expressly provided.
The Platform Operator may be contacted:
- electronically at the e-mail address indicated on the Platform;
- via the contact form available on the Platform;
- by post at the registered office address of the Platform Operator indicated on the website.
Authorities of the Member States of the European Union, the European Commission, and competent supervisory authorities may communicate with the Platform Operator in Polish or English at the contact address indicated on the Platform, in accordance with the DSA.
III. Types and Scope of ARTGOART Services
The ARTGOART Platform Operator provides Artists with access to the Platform, enabling contact between Clients and Artists (Managers) for the purpose of presenting, promoting, and ordering artistic and event-related services.
Through the Platform, Artists (Managers) may publish their offers, present their portfolio, manage date availability, and accept Bookings from Clients.
The ARTGOART Platform is available via the Website and, as the system develops, via mobile applications intended for Internet-connected devices.
The services provided by the Platform Operator include in particular:
- enabling the creation of an Artist Account and Artist Profile;
- making available tools for publishing offers of artistic services;
- making available a calendar system enabling management of availability and service Bookings;
- enabling communication between the Client and the Artist (Manager) through the Platform;
- enabling Clients to browse Artists’ offers and make Bookings;
- making available marketing tools for promoting artistic services within the Platform;
- making available functionalities enabling payments for services via external payment service providers.
When creating an Artist Account and Artist Profile, the Artist (Manager) shall provide the data necessary to use the Platform. Mandatory data are marked in the registration form.
The Artist may voluntarily expand their Artist Profile by adding promotional materials, such as photographs, video recordings, artistic portfolio, descriptions of previous work, and other information regarding the services offered.
The Platform Operator shall take measures to ensure the availability of the Platform, subject to technical interruptions, maintenance works, or events beyond the Operator’s control.
The Platform Operator reserves the right to develop and modify the Platform’s functionalities, including changes to the user interface, Booking methods, or available system tools, where such changes result from technological development of the Platform or operational needs.
Changes to the Platform functionalities referred to above shall not constitute an amendment to the Agreement concluded between the Platform Operator and the Artist, unless they affect the essential rights and obligations of the parties.
IV. Rules for Concluding and Terminating the Agreement
The Agreement between the ARTGOART Platform Operator and the Artist is concluded by completing the registration form available on the Platform and accepting these Terms.
The registration form indicates the data required to create the Artist Account and use the Platform.
The Agreement is concluded at the moment the Artist accepts the Terms during the registration process.
The Agreement is concluded:
- for an indefinite period – in the case of standard use of the Platform;
- for a fixed period – in the case of additional services or promotional packages offered by the Platform.
The Artist (Manager) and the Platform Operator may terminate the Agreement at any time with one month’s notice, effective at the end of the relevant billing period.
Termination may be submitted:
- electronically to the contact address indicated by the Platform Operator;
- via functionalities available in the Artist Account;
- in writing to the registered office address of the Platform Operator.
Termination of the Agreement shall not release the Artist from the obligation to settle all Fees due and accrued during the term of the Agreement.
The Platform Operator may terminate the Agreement with immediate effect in the event of:
- breach by the Artist of these Terms;
- publication of unlawful content or content contrary to public decency;
- carrying out activities infringing the rights of third parties;
- use of the Platform contrary to its intended purpose.
The Platform may offer new users a Trial Period during which access to selected functionalities is free of charge. The scope of functionalities available during the Trial Period may be limited.
Following the Trial Period, access to the full Platform functionalities may require the selection of one of the paid plans or acceptance of the applicable commission model.
If the Artist is a natural person conducting business activity and concludes the Agreement not directly related to their professional activity, such person shall be entitled to withdraw from the Agreement within 14 days of its conclusion without stating any reason.
A notice of withdrawal from the Agreement may be submitted electronically or in writing by sending the relevant statement to the contact details of the Platform Operator.
V. Detailed Conditions for the Provision of Services within the ARTGOART Platform
Access to the full functionalities of the ARTGOART Platform may require the Artist (Manager) to complete billing and invoicing details and, where required by the current Platform settlement model, to provide payment instrument details and consent to the charging of Fees, subscriptions, or commissions due to the Platform Operator in accordance with the applicable ARTGOART Price List.
The Artist shall provide complete, accurate, and up-to-date data, in particular identification, contact, billing, and all other information required for the proper provision of services by the Platform Operator. The Artist (Manager) shall also promptly update such data.
All communications concerning the Artist Account, changes to Platform functionalities, settlements, Bookings, system notifications, and accounting documents may be sent by the Platform Operator to the e-mail address, phone number, or other contact details indicated by the Artist. The Platform Operator shall not be liable for the consequences of providing false, incomplete, or outdated data.
Upon conclusion of the Agreement, the Platform Operator grants the Artist a non-exclusive, non-transferable, non-sublicensable, and time-limited right, for the duration of the Agreement, to use the Platform solely to the extent necessary to use its functionalities in accordance with these Terms and the intended purpose of the Platform.
The right referred to above includes solely the use of the Platform by displaying it in an internet browser, using the user account, and, where made available by the Platform Operator, using the mobile application or other tools provided by ARTGOART.
The Artist acknowledges that the ARTGOART Platform, its layout, software, functionalities, marks, graphic elements, databases, and other system components are protected by law, including copyright law and industrial property law. Any use of the Platform beyond the scope provided in these Terms is prohibited.
Creation of an Artist Account shall be deemed equivalent to:
- acceptance of these Terms and other documents made available by the Platform Operator;
- conclusion of an agreement for the provision of electronic services;
- confirmation that the data provided by the Artist (Manager) are true and accurate;
- confirmation that the Artist (Manager) is authorised to offer the services published through the Platform;
- consent to the processing of data to the extent necessary for the performance of the services provided by the Platform Operator in accordance with applicable law and the Privacy Policy.
The Artist (Manager) acknowledges and accepts that:
- Clients may contact them through the Platform’s communication tools or using contact details made available by the Artist (Manager);
- data and information placed by the Artist (Manager) in the public profile, including name, stage name, business description, photographs, recordings, offer, geographic scope of activity, portfolio, and reviews, may be visible to Clients and other Internet users;
- the Platform Operator may send system communications regarding the functioning of the Platform, technical changes, amendments to the Terms, organisational notifications, and billing notices.
Data and materials placed by the Artist (Manager) on the Platform are provided voluntarily, subject to data required for account creation and proper service provision by the Platform Operator.
One Artist Profile should correspond to one actual entity, group, performer, or one organised service offer, unless the Platform functionalities expressly allow a different presentation model.
It is prohibited to create multiple profiles in order to artificially increase visibility, circumvent settlement rules, publish the same services multiple times, or mislead Clients as to the number of performers, experience, or availability.
The Platform Operator may remove, merge, restrict, or block profiles created in breach of these Terms, after prior notice to remedy the breach or immediately where required for Platform security, protection of Clients’ interests, or compliance with applicable law.
If the Platform enables cooperation by multiple team members, managers, employees, or collaborators within one organisational account, the Artist or entity operating the account shall be responsible for proper assignment of roles, access updates, and ensuring that only authorised persons use the account.
The Artist (Manager) shall be liable for all actions of persons to whom access to the account has been granted, as for their own actions.
If additional functionalities relating to payments, invoicing, deposits, security deposits, sales documents, integration with external systems, or analytical tools are made available within the Platform, the terms of use of such functionalities may be set out in separate terms, price lists, or service descriptions.
The Artist (Manager) remains solely responsible for the compliance of their activity with applicable law, including tax, accounting, consumer, event organisation, copyright, labour, sanitary, safety, and any other regulations applicable to the services they offer.
VI. Artist Activity. Artist Content
The Artist (Manager) undertakes to use the ARTGOART Platform in compliance with the law, public decency, principles of fair dealing, and these Terms.
The Artist (Manager) undertakes that they shall:
- publish reliable, truthful, and non-misleading information;
- be authorised to offer all services presented through the Platform;
- hold the rights or relevant consents necessary to use all materials placed on the Platform;
- not infringe the rights of third parties, in particular copyright, related rights, industrial property rights, personal rights, or image rights.
The Artist (Manager) may place on the Platform content related to their activity, in particular service descriptions, photographs, audio and video recordings, graphics, portfolio, logos, stage identifiers, technical riders, organisational requirements, information on the composition of a group, indicative price lists, and other materials promoting their activity ("Artist Content").
By placing Artist Content on the Platform, the Artist (Manager) grants the Platform Operator a non-exclusive, royalty-free licence, valid for the duration of the Agreement and to the extent necessary for archival, evidentiary, and promotional purposes, to use the Artist Content for the purpose of:
- displaying it on the Platform;
- recording and reproducing it in the Platform Operator’s IT systems;
- making it publicly available in such a way that users may access it at a place and time individually chosen by them;
- using it to promote the Artist’s offer, the ARTGOART Platform, and the services of the Platform Operator;
- creating informational, advertising, and presentation materials connected with the operation of the Platform.
The licence referred to above includes the use of Artist Content on the Internet, social media, promotional materials, sales presentations, advertising campaigns, informational materials, and other communication channels used by the Platform Operator in connection with the operation and promotion of ARTGOART.
The Artist (Manager) represents that they hold the rights to the Artist Content to the extent necessary for its use by the Platform Operator in accordance with these Terms, and that the use of such content by the Platform Operator shall not infringe the rights of third parties.
If Artist Content contains the image of third parties, third-party artistic performances, musical works, recordings, photographs, elements of scenography, trademarks, or other protected assets, the Artist (Manager) represents that they hold all necessary consents, permissions, and rights for their use and for granting the Platform Operator the licence specified in these Terms.
The Artist (Manager) bears full responsibility for the Artist Content placed on the Platform and for the consequences of its publication. In the event of claims by a third party related to Artist Content, the Artist (Manager) shall cooperate with the Platform Operator in order to clarify the matter and remedy the damage if the claims prove justified.
The Platform Operator may, at its discretion and subject to applicable law, remove, hide, restrict the visibility of, or block Artist Content if it:
- is unlawful;
- breaches these Terms;
- infringes the rights of third parties;
- misleads Clients;
- may jeopardise the safety of users or the reputation of the Platform.
It is prohibited to publish, offer, promote, or disseminate via the Platform content or services that are:
- contrary to law;
- contrary to public decency;
- pornographic or explicitly sexual in nature;
- inciting violence, hatred, or discrimination;
- connected with criminal activity, narcotic substances, unlawful gambling, or other prohibited activity;
- infringing the personal rights, reputation, or intellectual property rights of others;
- misleading as to qualifications, experience, line-up, service quality, price, availability, references, or place of performance;
- intended to circumvent the Platform’s operating rules or divert traffic and Bookings in breach of these Terms.
The Artist (Manager) further undertakes to:
- use the Platform solely in accordance with its intended purpose;
- not copy, distribute, or use the content of other users without legal basis;
- not engage in actions disrupting the functioning of the Platform;
- not disclose the account to unauthorised persons;
- immediately notify the Platform Operator of unauthorised account access or security breaches;
- cooperate with the Platform Operator in the event of checks, verification, or handling of infringement reports.
If the Artist places on the Platform their logo, name, stage designation, trademark, or other sign identifying their activity, it shall be deemed that the Artist consents to the use of such signs by the Platform Operator for the purpose of presenting the Artist’s offer and promoting the ARTGOART Platform, to the extent connected with the performance of the Agreement and the functioning of the Platform.
Deletion of the account or termination of cooperation with the Platform shall not affect the Platform Operator’s right to continue storing and using Artist Content to the extent necessary to comply with legal obligations, pursue or defend claims, archive data, compile statistics, and document the history of cooperation and transactions.
The Platform Operator is not obliged to monitor all Artist Content prior to publication but may conduct verification, moderation, and security activities to the extent required by law, by the Platform’s legitimate interest, or by the need to protect other users.
VII. Booking of Artistic Services, Confirmation and Cancellation
A Booking of an artistic service is made through the ARTGOART Platform by the Client selecting the Artist’s offer and indicating the service date.
A Booking may be confirmed:
- automatically by the Platform system, if the Artist uses automatic booking confirmation; or
- manually by the Artist or the Manager managing the Artist Profile.
An agreement between the Client and the Artist is concluded at the moment the Booking is confirmed.
The Artist may independently determine the booking confirmation mode in their profile settings. If the manual mode is selected, the Artist undertakes to respond to a booking request within no more than 24 hours from receipt.
If the Booking is not confirmed within the above time limit, the request may be automatically marked as unconfirmed, and the Client shall not be obliged to proceed with the Booking.
The Artist bears full responsibility for the performance of services offered via the Platform and for the conformity of the service with the information presented in the offer.
The Artist may specify detailed terms for the performance of the Booking ("Booking Conditions"), in particular concerning:
- the requirement for a deposit or prepayment;
- the amount of a security deposit;
- the minimum advance booking period;
- cancellation rules.
The Booking Conditions must be made available to the Client before the Booking is made in a manner allowing the Client to review them.
A Booking may be conditional upon payment by the Client of a deposit or prepayment for the service.
The deposit or prepayment may be collected via the payment system available on the Platform or through the services of an external payment service provider.
Where the Client does not make the required prepayment within the period specified by the Artist, the Booking may be automatically cancelled.
The Artist may set a cut-off date up to which the Client may cancel the Booking without incurring costs.
If the Client cancels the Booking after that deadline or fails to appear at the place of service performance, the Artist may retain the paid deposit or prepayment in accordance with the Booking Conditions.
The Client may cancel the Booking through the Platform, unless the nature of the service or individual Booking Conditions provide otherwise.
If the Booking is cancelled in accordance with the Booking Conditions, any refund shall be made through the payment service provider used for the payment.
The ARTGOART Platform is not a party to the agreement concluded between the Client and the Artist and shall not be liable for the performance of artistic services, except where required by mandatory provisions of law.
The Platform Operator may verify selected Bookings in order to prevent abuse, in particular where there is suspicion of price manipulation, fictitious bookings, or other actions breaching the Platform rules.
VIII. Fees, Commissions and Settlements
The use of selected functionalities of the ARTGOART Platform may be subject to the payment of Fees by the Artist in accordance with the applicable ARTGOART Price List.
Fees may include in particular:
- a subscription fee for use of the Platform;
- a commission on the value of completed Bookings;
- fees for additional functionalities or promotional services;
- other fees specified in the ARTGOART Price List.
Under the commission model, the ARTGOART Platform may collect a commission on the value of the service booked through the Platform.
The amount of the commission is specified in the current ARTGOART Price List and may depend on the type of service, user package, or other factors determined by the Platform Operator.
Fees may be collected:
- automatically from the payment instrument indicated by the Artist;
- by deduction from the payment made by the Client;
- on the basis of an invoice issued by the Platform Operator.
The Artist consents to receiving invoices in electronic form at the e-mail address indicated upon registration of the Artist Account.
Electronic invoices may be sent in an electronic format ensuring the authenticity of origin, integrity of content, and legibility of the document.
The Artist is obliged to ensure the correctness of invoicing data and to update such data in the event of any change.
In the event of delay in payment, the Platform Operator may:
- restrict access to selected Platform functionalities;
- suspend the Artist Account;
- withhold the payout of funds due to the Artist.
Access to the account may be restored after outstanding amounts have been settled.
Where the Client’s payment is made through a payment service provider integrated with the Platform, the funds transferred to the Artist may be reduced by:
- the ARTGOART Platform commission;
- payment service provider fees;
- other fees resulting from the applicable terms of payment services.
Detailed rules concerning settlements, payout of funds, and payment schedules may be set out in separate documents, in particular in the ARTGOART Price List or regulations concerning additional services.
IX. Purchases and Additional Services
The ARTGOART Platform may provide functionality enabling users, in particular Artists or Managers, to purchase products or services related to artistic, event-related, or creative activities ("Purchases").
Within the Purchases functionality, sales agreements may be concluded between the Platform user and an external supplier of products or services ("Seller").
The ARTGOART Platform Operator is not a party to sales agreements concluded between the user and the Seller, unless expressly indicated otherwise in the offer of the product or service.
All conditions relating to the sale, including prices, delivery terms, warranty, complaints, or returns, shall be determined by the Seller and made available to the user before the conclusion of the sales agreement.
Each sales agreement shall be governed by:
- the Seller’s terms and conditions;
- generally applicable provisions of law.
Prices of products and services available in the Purchases section are displayed in the currency indicated in the relevant offer and include tax where required by law.
Product prices do not include delivery costs unless expressly stated otherwise in the offer.
A sales agreement is concluded by completing the following steps:
- selecting a product or service available in the Purchases section;
- adding the selected product to the cart;
- selecting the payment method and the delivery method or service fulfilment method;
- providing the data necessary to complete the order;
- accepting the Seller’s terms and conditions;
- making payment using the available payment methods.
After placing an order, the user will receive confirmation of receipt electronically.
The sales agreement is concluded once the Seller confirms acceptance of the order for fulfilment.
The Seller is responsible for:
- delivering a product or service compliant with the agreement;
- performing the service in accordance with its description;
- handling complaints and any returns.
The ARTGOART Platform Operator shall not be liable for:
- the quality of products or services offered by Sellers;
- the accuracy of information provided by Sellers;
- the fulfilment of orders by Sellers.
Any complaints concerning purchased products or services shall be submitted directly to the Seller in accordance with the Seller’s rules.
Personal data of the user necessary for order fulfilment may be transferred to the Seller for the purpose of performing the sales agreement.
Detailed information on the processing of personal data by the Seller should be made available by the Seller in its terms and conditions or privacy policy.
X. Reviews and Rating System
The ARTGOART Platform enables Clients to publish reviews regarding Artists and the services provided by them ("Reviews").
A Review may include:
- a score on a points or star scale;
- a text comment concerning the quality of the service.
Reviews may be published only by users who have booked a service through the Platform or confirmed that they used the service.
The Platform may label reviews originating from users who actually used the service as verified reviews.
Reviews published on the Platform are publicly visible and may also be accessible to persons who do not hold a user account.
Reviews are displayed chronologically or according to other criteria determined by the Platform Operator.
Artist Profiles may display rating statistics, in particular:
- average service rating;
- number of published reviews;
- distribution of ratings across specific categories.
The Artist or the Manager managing the Artist’s profile has the right to publish a response to a Review.
A response to a Review should relate to the content of the Review and may not infringe applicable law or these Terms.
It is prohibited to publish Reviews that are:
- false or misleading;
- offensive or defamatory;
- vulgar or inciting violence;
- infringing the rights of third parties.
It is prohibited for an Artist (Manager) to publish Reviews concerning their own activity, or for persons acting on their behalf, including employees, collaborators, or affiliated persons, to do so.
It is prohibited to offer any material or non-material benefit in exchange for publishing a positive Review or removing a negative Review.
The Platform Operator may remove a Review or a response thereto if:
- it breaches these Terms;
- it breaches applicable law;
- it has been published in an unfair or manipulative manner.
A Review may also be removed pursuant to a final court judgment or a decision of a competent authority.
The Platform Operator may introduce mechanisms preventing manipulation of Reviews, in particular user account verification or analysis of rating system activity.
Making changes to a Booking or manipulating the service completion status in order to prevent the Client from adding a Review is prohibited.
If such actions are identified, the Platform Operator may restore the Client’s ability to add a Review or take other measures provided for in these Terms.
XI. Rights and Liability of the ARTGOART Platform Operator
The ARTGOART Platform Operator is not a party to agreements concluded between Clients and Artists or Managers, in particular agreements concerning the performance of artistic services booked through the Platform.
The Platform Operator only provides technological tools enabling the presentation of offers, communication between users, and the making of Bookings.
Responsibility for the performance of services, their quality, conformity with the offer, and settlements between the Client and the Artist rests solely with the Artist or the entity representing the Artist, including the Manager.
The Artist shall provide services in compliance with applicable law, in particular provisions concerning business activity, consumer rights, copyright law, and the safety of organised events.
The Platform Operator may carry out verification activities in relation to content published on the Platform, in particular as to compliance with these Terms and applicable law.
If the Platform Operator obtains information about a possible breach of these Terms, applicable law, or the rights of third parties, it may take appropriate action to clarify the matter.
In particular, the Platform Operator may take one or more of the following measures:
- request the user to remove or amend content breaching these Terms;
- restrict the visibility of specific content or offers;
- temporarily restrict access to selected Platform functionalities;
- temporarily suspend the Artist or Manager Account;
- permanently delete the user account in the event of a serious breach of these Terms.
In situations requiring immediate action, in particular where user safety is at risk or the law is being infringed, the Platform Operator may take the above measures without prior notice to the user.
The Platform Operator may also provide competent authorities or authorised entities with user data to the extent required by applicable law or for the purpose of pursuing claims.
The Platform Operator shall not be liable for:
- acts or omissions of Clients, Artists, or Managers;
- the quality or proper performance of artistic services;
- the accuracy of information published by Platform users;
- the content of Reviews published by users;
- interruptions in the operation of the Platform resulting from technical causes, ICT system failures, or force majeure;
- technical issues resulting from the user’s device, software, or telecommunications network;
- damage resulting from a user’s breach of these Terms.
The Platform Operator does not guarantee that users will achieve any specific business results, in particular any number of Bookings, sales level, or number of Clients.
The Platform Operator may temporarily suspend access to the Platform for technical, maintenance, or upgrade works.
If cooperation with a user ends, the Platform Operator may delete the Artist or Manager Account and related data after the period necessary to fulfil legal obligations and data archiving requirements.
At the user’s request, the Platform Operator may provide a copy of account-related data to the extent required by law.
The Platform Operator shall not be liable for content placed by users, provided that it has no actual knowledge of its unlawful character and, upon obtaining such knowledge, takes prompt action to remove or disable access to such content.
In order to ensure the proper functioning of the Platform and improve service quality, the Platform Operator may apply ranking mechanisms presenting Artists’ offers in search results.
Offer ranking may depend in particular on such factors as:
- the Artist’s location or geographic scope of activity;
- service availability;
- popularity of the offer and number of Bookings;
- average rating resulting from Client Reviews;
- completeness and quality of information contained in the Artist Profile;
- activity of the user within the Platform;
- use of promotional services offered by the Platform.
The Platform Operator may apply promotional tools or features increasing the visibility of offers in search results in accordance with the conditions specified in the ARTGOART Price List or regulations concerning additional services.
XII. Complaints. Notices Concerning Illegal Content
A user, including an Artist, Manager, or Client, may submit complaints concerning malfunction of the ARTGOART Platform, technical errors, irregularities in account operation, or other electronic services provided by the Platform Operator.
A complaint may be submitted:
- electronically to the e-mail address designated by the Platform Operator for complaint matters;
- via the contact form available on the Platform;
- in another manner made available by the Platform Operator.
A complaint should include at least:
- data identifying the complainant;
- a description of the problem or irregularity;
- identification of the account, service, Booking, or content concerned, where applicable;
- contact details enabling a response to be provided.
Complaints shall be handled without undue delay, and no later than within 30 days from the date of receipt, subject to particularly complex cases where this period may be extended accordingly.
If consideration of the complaint requires additional information, the Platform Operator may request the complainant to provide further data or explanations.
The response to the complaint shall be sent to the e-mail address or other contact channel from which the complaint was submitted, unless the complainant indicates another method of delivery.
Complaints concerning artistic services, the quality of service performance, the conduct of the Artist, Manager, or Client, as well as complaints concerning products or services purchased from third parties via the Purchases functionality, should be directed to the entity that is a party to the relevant agreement, unless these Terms expressly provide otherwise.
Any person may notify the Platform Operator of content they consider illegal, unlawful, or in breach of these Terms, in particular content infringing third-party rights, personal rights, copyright, fair dealing rules, or user safety.
A notice regarding Illegal Content should, where possible, include:
- precise identification of the content concerned;
- a justification as to why, in the notifier’s opinion, the content is illegal or contrary to these Terms;
- contact details of the notifier, if feedback is requested.
Upon receipt of a notice, the Platform Operator may:
- leave the content unchanged;
- restrict its visibility;
- remove the content;
- block access to the content;
- take further measures provided for in these Terms against the user responsible for publishing the content.
If the Platform Operator’s decision concerns removal of content, restriction of visibility, suspension of account functionalities, suspension of the account, or deletion of the account, the user affected by the decision may lodge an appeal within a reasonable period indicated by the Platform Operator, not shorter than 14 days from the date on which the user was informed of the decision.
The Platform Operator shall handle appeals in an impartial manner and within a reasonable time, taking into account the circumstances of the case, the submitted materials, and applicable law.
The Platform Operator may refuse to consider notices, complaints, or appeals that are manifestly unfounded, repetitive, or constitute an abuse of rights, after informing the notifying person of the reasons for such decision.
In the event of frequent publication of manifestly unlawful content, frequent submission of manifestly unfounded notices, or abuse of complaint and appeal procedures, the Platform Operator may, after prior warning, temporarily restrict access to certain Platform functionalities.
When assessing whether an abuse has occurred, the Platform Operator shall consider in particular the scale of the infringements, their repetitiveness, their effects on other users, and the nature of the conduct of the notifier or user.
XIII. Technical Requirements
Use of the ARTGOART Platform requires a device enabling Internet access and the use of an up-to-date web browser or mobile application, if such application has been made available by the Platform Operator.
Proper use of the Platform requires:
- an active Internet connection;
- an active e-mail address;
- the ability to receive system messages;
- for selected functionalities, an active phone number.
The Platform Operator recommends the use of the latest stable versions of popular web browsers, in particular those supporting modern data security and encryption standards.
If the Platform is used via a mobile device, the user should have a technically functional device with an up-to-date operating system and properly configured Internet access.
Certain Platform functionalities may require:
- cookies to be enabled;
- JavaScript to be enabled;
- consent to receive push notifications;
- access to the camera, microphone, or device location, if the user wishes to use functionalities that require such access.
Failure to meet the technical requirements may result in limitations in using the Platform, including problems with logging in, displaying content, making Bookings, uploading materials, or receiving notifications.
The Platform Operator uses cookies and similar technologies to ensure the proper functioning of the Platform, maintain user sessions, improve security, compile statistics, and adapt services to users’ needs, in accordance with the Privacy Policy or Cookie Policy.
The user shall be responsible for securing their account access data, in particular by not disclosing login credentials and passwords to unauthorised persons, using appropriate device protection, and keeping software up to date.
The user shall be liable for the actions of persons to whom they have granted access to the account, unless such access resulted from a security breach attributable to the Platform Operator.
If unauthorised access to the account is suspected, the user should immediately change the password and inform the Platform Operator accordingly.
XIV. Electronic and Mobile Payments
The ARTGOART Platform may enable the acceptance and processing of electronic payments related to the booking of artistic services, the payment of deposits, prepayments, security deposits, or Fees due in connection with use of the Platform.
Such payments may be processed by an external payment service provider cooperating with the ARTGOART Platform.
Use of payment functionalities may require:
- acceptance of the payment service provider’s terms of service;
- activation of the relevant functionality in the user account;
- provision of the data necessary to identify and settle the payment.
The ARTGOART Platform Operator does not provide payment services, unless expressly indicated otherwise, and is not a party to the agreement concluded between the user and the payment service provider.
The Client may make payments for the Artist’s services using the payment methods made available on the Platform, including in particular payment cards, electronic bank transfers, mobile payment systems, or other methods offered by the payment service provider.
Availability of specific payment methods may depend on the type of service, the user’s country, the payment service provider, the transaction currency, and the current technical capabilities of the Platform.
An Artist or Manager using payment acceptance functions shall use them in compliance with the law, these Terms, and the terms applicable at the payment service provider.
Where payments are made through the Platform, the funds payable to the Artist may be reduced by:
- the Platform Operator’s commission;
- payment service provider fees;
- other amounts resulting from the accepted settlement model.
Detailed rules regarding commissions, operational costs, transaction fees, payout dates, and settlement schedules are set out in the ARTGOART Price List or separate payment service terms.
The Platform Operator may enable the handling of:
- deposits;
- prepayments;
- security deposits;
- post-performance payments;
- refunds;
- partial settlements or milestone payments, where such functionality is made available.
The user acknowledges that the payment service provider may refuse, block, delay, or refund a transaction in the event of suspected illegality, fraud, lack of authorisation, breach of the payment provider’s terms, or increased transactional risk.
In the event of a chargeback, payment complaint, reversal of transaction, or dispute raised by the payer, the Platform Operator may cooperate with the payment service provider and the user in order to clarify the matter and provide the necessary transaction information.
The Artist or Manager shall provide the Platform Operator or the payment service provider with all information necessary to consider a payment dispute, chargeback, or transaction complaint within the period specified in the request.
Lack of cooperation by the user may result in their position not being taken into account in the procedure conducted by the payment service provider or in restriction of access to payment functionalities.
If the number of payment disputes, chargebacks, or suspicious transactions concerning a given user is excessive, the Platform Operator may:
- temporarily restrict access to electronic payments;
- withhold payouts;
- require additional user verification;
- impose additional security or settlement conditions;
- suspend access to selected payment functionalities.
The user bears sole responsibility for the proper settlement of taxes, public levies, social contributions, accounting obligations, and other liabilities connected with receiving payments for their services, unless mandatory provisions of law provide otherwise.
Payment functionalities may not be used for prohibited, unlawful, sham, or Terms-breaching activity, in particular for transactions unrelated to genuine services offered through the ARTGOART Platform.
The Platform Operator may provide reports, statements, or payment history within the user account, but such data are of an auxiliary and informational nature unless expressly stated otherwise.
XV. Additional Services and External Integrations
The ARTGOART Platform may provide users with additional services, modules, integrations, or tools supporting artistic, creative, or event-related activities.
Additional services may include in particular:
- promotional modules;
- analytical tools;
- calendar and team management systems;
- social media integrations;
- tools for handling documents, contracts, riders, requests for proposals, or settlements;
- solutions supporting communication with Clients;
- integrations with external service providers.
Activation of certain additional services may require acceptance of separate terms, regulations, or price lists.
Where a given additional service is provided by a third party, the agreement concerning that service may be concluded directly between the user and that third party.
The ARTGOART Platform Operator is not a party to agreements concluded between the user and an external provider of additional services, unless expressly stated otherwise.
The Platform Operator shall not be liable for the manner in which services provided by third parties operate, their availability, quality, security, or conformity with the user’s expectations, unless such liability follows directly from applicable law.
Where an additional service provided by a third party is activated, user data may be made available to that third party to the extent necessary for activation and provision of the service, in accordance with applicable law and data protection rules.
The terms of use of additional services, including rules on payment, complaints, termination, and liability, may be specified separately for each service.
The Platform Operator may restrict the availability of certain additional services to specific user groups, subscription plans, markets, or promotional periods.
XVI. Personal Data and Privacy
To the extent that the ARTGOART Platform Operator, the Artist, the Manager, and the Client process personal data for their own independently determined purposes, each of them acts as a separate data controller, unless these Terms, a separate agreement, or applicable law provide otherwise.
The Platform Operator is the controller of users’ personal data in connection with:
- maintaining accounts on the Platform;
- registration and login handling;
- ensuring the functioning of the Platform;
- processing payments and settlements, where applicable;
- handling complaints, security, and technical support;
- fulfilling legal obligations incumbent on the Platform Operator.
The Artist or Manager becomes a separate controller of the Client’s personal data to the extent that such data are used by them for service performance, communication with the Client, fulfilment of the Booking, handling of orders, settlements, and the performance of legal obligations related to their business activity.
If, for the purpose of providing services through the ARTGOART Platform, it is necessary for the Platform Operator to process personal data for which the Artist or Manager remains the controller, such processing shall take place on the basis of an appropriate data processing agreement or another proper legal basis.
An Artist or Manager using tools made available by the Platform for managing Bookings, communication, client database, marketing, or other processes related to their activity shall ensure the lawfulness of personal data processing within their own activity.
The Platform Operator shall not be liable for the scope of personal data entered into the Platform by the Artist, Manager, or other persons acting on their behalf, nor for the lawfulness of the processing of such data by those entities, unless such liability follows from mandatory provisions of law.
The user shall in particular be obliged to:
- process personal data lawfully;
- have an appropriate legal basis for processing;
- fulfil information obligations towards data subjects;
- ensure appropriate security measures.
Detailed information concerning the Platform Operator’s processing of personal data, the legal bases for processing, purposes of processing, retention periods, recipients of data, and the rights of data subjects are set out in the ARTGOART Privacy Policy.
Information concerning cookies, similar technologies, and the rules for their use are made available in the Cookie Policy or in the relevant section of the Privacy Policy.
To the extent permitted by law, the Platform Operator may also process users’ personal data for the purposes of pursuing claims, defending against claims, preventing abuse, ensuring the security of services, carrying out statistical analysis, and developing the Platform.
When payment services, external integrations, additional services, or tools provided by third parties are used, personal data may be transferred to such third parties to the extent necessary to perform the service, in accordance with the relevant legal bases. Where required by law, the Platform Operator or the user may be obliged to conclude separate documents governing the rules for personal data processing, in particular data processing agreements.
