Refund Policy
ARTGOART REFUND POLICY
I. General Provisions
This Refund Policy sets out the rules for processing refunds in connection with bookings of artistic services made via the ARTGOART Platform.
The ARTGOART Platform acts as an intermediary between the Client and the Artist and, as a rule, is not a party to the contract for the provision of artistic services.
Refunds are processed in accordance with:
- the Booking Terms specified by the Artist,
- the ARTGOART Terms and Conditions,
- applicable laws and regulations.
II. Types of Payments
The following types of payments may be used within the Platform:
- deposit,
- prepayment,
- full payment,
- security deposit,
- milestone or staged payments (if such functionality is available).
Each of the above payment types may be subject to different refund rules, as specified by the Artist in the Booking Terms.
III. Refunds in Case of Cancellation by the Client
The Client may cancel a Booking in accordance with the Booking Terms provided prior to making the Booking.
Unless otherwise specified in the Booking Terms:
- cancellation before the service date may result in a full or partial refund,
- cancellation after the deadline set by the Artist may result in forfeiture of the deposit or prepayment,
- failure of the Client to appear may be treated as cancellation without entitlement to a refund.
Refunds are processed via the payment operator used for the transaction.
IV. Refunds in Case of Cancellation by the Artist
In the event of cancellation of a confirmed Booking by the Artist:
- the Client is entitled to a refund for the unperformed part of the service,
- the refund includes payments made through the Platform,
- the Platform may take actions against the Artist in accordance with the Terms and Conditions.
ARTGOART may, without guarantee, attempt to find a replacement performer.
V. Refunds in Case of Non-Performance or Improper Performance
In the event of a dispute between the Client and the Artist:
- ARTGOART may temporarily hold the funds,
- the parties may be required to provide evidence,
- the decision regarding the funds may include:
- full refund,
- partial refund,
- release of funds to the Artist,
- split of funds between the parties.
Any decision made by ARTGOART is operational in nature and does not limit the parties’ right to pursue claims through legal or out-of-court procedures.
VI. Refunds and Payment Operators
Refunds are processed via an external payment service provider.
The time required to complete a refund depends on:
- the payment operator,
- the Client’s bank or financial institution,
- the payment method used.
ARTGOART shall not be liable for delays resulting from the operation of payment service providers.
VII. Fees and Deductions
Refunds may be reduced by:
- the Platform commission (if specified as non-refundable),
- payment operator fees,
- transaction processing costs,
- other amounts due under the Terms and Conditions.
VIII. Chargebacks and Payment Disputes
In the event of a chargeback or payment dispute:
- ARTGOART cooperates with the payment operator,
- funds may be held until the matter is resolved,
- the user is required to provide necessary information.
Failure to cooperate may result in the rejection of the user’s claims.
IX. Refunds and Consumers
If the Client is a Consumer or a business acting with consumer rights:
- consumer protection laws shall apply,
- the right of withdrawal may be excluded in the case of services provided on a specific date or period,
- Booking Terms must not violate mandatory consumer protection laws.
X. Limitation of Liability
ARTGOART shall not be liable for:
- decisions made by the Artist regarding refunds,
- the performance or non-performance of the service,
- disputes between the Client and the Artist,
- delays caused by payment service providers.
XI. Final Provisions
This Policy constitutes a supplement to the ARTGOART Terms and Conditions.
In the event of any inconsistency, the Terms and Conditions and applicable laws shall prevail.
ARTGOART may amend this Policy in accordance with the Terms and Conditions.
This Policy shall enter into force on 22.05.2026.
